1. General
1.1 You may access ARCHIMEDlife’s webportal without disclosing personal information. In such a case, ARCHIMEDlife does not gather any access data from which conclusions about your identity can be drawn. The non-personal data gathered will only be used for analysis purposes to help ARCHIMEDlife continuously improve its range of offers and services.
1.2 ARCHIMEDlife will only collect personal data if you have decided to use those webportal functions for which a personal identification is required, and you enter such data there.
1.3 Where the personal data of third persons are required, for instance, to access analyses, reports, or findings of samples on the webportal, then, by entering such third-person data, you confirm that they have consented to the disclosure of their data and that you have obtained their consent in conformity with the law. You agree to defend and hold ARCHIMEDlife harmless with regard to all possible claims of third persons or authorities in this respect. This also includes costs incurred in connection with ARCHIMEDlife’s defense, if any.
1.4 The personal data made available to ARCHIMEDlife will only be used for the functions stated there, in particular those enabling the tracking of samples. The disclosure of personal data allows us to provide you with access to analyses, reports, or findings of samples submitted, or to get in touch with you. At no time will ARCHIMEDlife transfer or disclose such data to third parties or make use of them beyond this Privacy Statement. If you are participating in a sponsored diagnostic program, we may share contact details with the Sponsor in order to facilitate account registration and activation in the ARCHIMEDlife WEBPORTAL allowing us to complete the delivery of our services.
2. Contact form
2.1 In order to be able to contact ARCHIMEDlife via the webportal you must complete the contact form. The following data are required: full name, academic title, gender, mailing address, phone number, e-mail address; name and address of the hospital or healthcare institution.
2.2 The submitting physician, or the healthcare institution, in order to access, via the webportal, the analysis, re-port, or findings report, has to provide the following data in addition to the information required under 2.1 above: name of the hospital/institution/physicians’ practice and, if necessary, of the department, address, fax number. Business name and name of your department (optional) and address; fax number.
2.3 For the processing of patient samples, the following personal data regarding the patient are required: the patient’s full name, date of birth, and gender; for minors, also the name of the legal representative.
2.4 Agreements deviating from or supplementing these GTC are only valid for the respective legal transaction yet not for other legal transactions, in particular not for subsequent transactions.
2.5 Changes to these GTC shall be deemed approved and are also effective for existing contracts unless the user objects within one month after receipt of the amended GTC. The amended GTC may also be transmitted by electronic means (e.g., by e-mail).
3. E-Mails to ARCHIMEDlife/your Rights
3.1 If you have any questions or concerns regarding the use of your data, please contact ARCHIMEDlife. The contact details can be found on the webportal. If you contact us by e-mail, ARCHIMEDlife collects and stores the information you provide, including your e-mail. However, ARCHIMEDlife will use your personal information in identifiable form only to respond to your request. In addition, ARCHIMEDlife may use your data in an anonymous form (so that no conclusions can be drawn from them about your identity) for statistical purposes.
3.2 In accordance with the applicable law you may at any time request information on any access to your personal data that ARCHIMEDlife collected and stored. You are also entitled to update such data, correct, block, delete, or object to the processing of such data.

4. Data Transfer
4.1 ARCHIMEDlife is entitled to commission a third party to backup, store, and process your data on behalf of ARCHIMEDlife. ARCHIMEDlife has made the necessary contractual arrangements to ensure that the service provider commissioned by ARCHIMEDlife will act in compliance with ARCHIMEDlife’s instructions and store and process the data only for the purpose of providing this website and the services and features offered on this website.
4.2 ARCHIMEDlife further undertakes not to transfer, or disclose in any other form, your personal data, or third-party data, to any third party without your consent, unless this is expressly permitted or required by law.
5. Data security
5.1 ARCHIMEDlife assures you to have the required and appropriate technical and organizational security measures in place to protect your personal data and third-party data from unauthorized access or use, destruction, alteration, or loss.
5.2 ARCHIMEDlife makes personal data available only to its own staff or to subcontractors or diagnosing physicians who require this information for the purpose of providing the webportal and the services and features offered on the webportal. If you are participating in a sponsored diagnostic program, we may share contact details with the Sponsor in order to facilitate account registration and activation in the ARCHIMEDlife WEBPORTAL allowing us to complete the delivery of our services.
6.1 As with almost all websites, also ARCHIMEDlife uses cookies. Cookies are small text files sent to your browser from a web server and stored on your device. With the exception of tracking cookies for Google Analytics (for more details, see item 7. below), all the cookies used by ARCHIMEDlife are deleted when your browser session is terminated. The use of these cookies is necessary for you to access the webportal and use its features.
6.2 The information ARCHIMEDlife receives through the use of cookies is used to continuously improve the services offered by ARCHIMEDlife. Most browsers accept cookies automatically. However, you can change your browser settings so that you are notified when cookies are being sent and you can decide on a case-by-case basis whether you accept or decline cookies, or to reject all cookies. In such a case, however, you will probably not be able to make full use of some of the webportal’s features.
7. Use of Google Analytics and Matomo (formerly Piwik)
7.1 ARCHIMEDlife makes use of Google Analytics, a web analysis service of Google, as well as Matomo (formerly Piwik). The cookies used in that context provide ARCHIMEDlife with information on your use of the webportal, which helps to further improve the service of the webportal. Please note that, in connection with the use of Google Analytics, the information obtained through the use of cookies is transferred to servers in the USA and stored there. Within the Member States of the European Union or in other contracting states to the Agreement on the European Economic Area your IP address is truncated. It is only in exceptional cases that your full IP address will be transferred to a Google server in the USA and truncated there. On behalf of ARCHIMEDlife, Google will use such information to evaluate your use of the webportal, to compile reports on website activities for the website operators, and to provide further services related to the use of the website and the Internet. Google will not associate the IP address sent by your browser in connection with Google Analytics with other data held by Google. You may refuse the use of cookies by selecting the appropriate setting in your browser. Please note that if you do this you will no longer be able to use the full functionality of the webportal. If you choose to deactivate Google Analytics also for the future, you can download and install the Google Analytics deactivation add-on for the browser you are using from http://tools.google.com/dlpage/gaoptout?hl=de.
8. ARCHIMEDlife Newsletter
8.1 ARCHIMEDlife publishes a Newsletter at regular intervals to provide information about current developments. The ARCHIMEDlife Newsletter will be sent to you only if you explicitly agree to the sending of the Newsletter. Our website features a separate consent button and the wording “I expressly agree to receive the ARCHI-MEDlife Newsletter and understand that I can revoke my agreement at any time.”
8.2 You can unsubscribe from the ARCHIMEDlife Newsletter at any time, e.g. by clicking the “unsubscribe” link in the e-mail you have received, or by sending an e-mail or a letter to the contact data.
9. Changes to the Privacy Statement
9.1 ARCHIMEDlife reserves the right to change this Privacy Statement at any time with effect for the future. The current version of this Privacy Statement is always available on the webportal.
9.2 Please check at regular intervals for changes in the Privacy Statement to be informed at any time about the collection, processing, and use of your personal data.
